1. Acceptance of these terms

These Terms of Use govern your access to and use of mortgagesbytrev.ca (the “Site”). By visiting the Site, using any calculator, reading any strategy explainer, submitting a form, or booking a call, you agree to be bound by these terms. If you do not agree, please do not use the Site.

These terms apply to every page on mortgagesbytrev.ca and to any tools, content, or communications you receive through the Site.

2. What this Site is

mortgagesbytrev.ca is an educational website. It hosts mortgage calculators, strategy explainers, articles, and a way to get in touch or book a strategy call. Everything on the Site is provided for general information and planning purposes only.

Nothing on this Site is financial, mortgage, tax, legal, accounting, or investment advice. Using the Site, reading any page, or running a calculator does not create a client relationship, an agent and client relationship, a fiduciary relationship, or any other professional relationship between you and Trevor Hough or The Mortgage Coach.

This section should be read together with the Disclaimer, which forms part of these terms.

3. Who Trevor Hough is

Trevor Hough is a Mortgage Agent Level 2 licensed in Ontario under The Mortgage Coach, FSRA Brokerage Licence #13120. You can verify this licensing through the FSRA public registry, linked from the footer of every page on the Site.

Any actual mortgage application, pre-approval, or financing arrangement is conducted separately under the regulated processes of The Mortgage Coach, after a strategy call and proper intake. The Site itself does not originate mortgages, accept applications, accept payment, or hold funds. Trevor is not a licensed tax professional, lawyer, accountant, or investment advisor, and nothing on the Site should be treated as advice from those professions.

4. No financial advice

Every calculator, strategy explainer, article, and tool on the Site is a general planning aid. The content does not take into account your specific financial situation, goals, risk tolerance, tax position, or legal circumstances.

Before acting on anything you read or calculate here, you should consult the appropriate licensed professional. For mortgage product and structure decisions, speak with a licensed mortgage agent or broker. For tax matters, including any strategy that touches interest deductibility, speak with a Chartered Professional Accountant (CPA) or other qualified tax professional. For legal questions, including title, ownership structure, or contract review, speak with a lawyer licensed in your jurisdiction.

5. Calculator output

The calculators on the Site (including the mortgage payment, affordability, closing cost, debt consolidation, refinance, rent vs. buy, rental cash flow, investment leverage, and rental cash damming tools) run on inputs you provide and on simplified assumptions about rates, amortization, taxes, and other variables.

Results are illustrative only. They are not a rate quote, not a pre-approval, not a commitment to lend, and not a guarantee of any tax outcome or investment return. Actual mortgage rates, qualifying amounts, tax treatment, and investment results depend on your individual circumstances, current market conditions, lender underwriting, and applicable law, all of which can change.

6. No guaranteed outcomes

The Site and all content on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Trevor Hough and The Mortgage Coach make no representations or warranties of any kind, express or implied, about the Site, its calculators, its content, its availability, its accuracy, its completeness, its fitness for a particular purpose, or its non-infringement of third party rights.

Words like “may,” “could,” “illustrates,” and “estimate” are used intentionally. They reflect the educational nature of the Site and the fact that real outcomes depend on real circumstances.

7. Acceptable use

When you use the Site, you agree that you will not:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Site, its servers, its underlying infrastructure, or any related systems or accounts.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying logic of any calculator or tool, except to the extent expressly permitted by law.
  • Scrape, harvest, or systematically extract content, data, or calculator outputs from the Site by automated means without prior written permission.
  • Interfere with or disrupt the Site, including by introducing viruses, malware, or other harmful code, or by overloading the Site with excessive requests.
  • Use the Site or its content to impersonate Trevor Hough, The Mortgage Coach, or any other person, or to misrepresent your affiliation with any of them.
  • Resell, sublicense, or commercially exploit the Site or its content without prior written permission.

8. Intellectual property

All content on the Site, including the calculators, strategy explainers, articles, written copy, illustrations, layouts, branding, and underlying code, is owned by Trevor Hough or used with permission, and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may share publicly available URLs to pages on the Site, link to the Site from your own website or social channels, and reference short excerpts with proper attribution. You may not copy, republish, redistribute, or repurpose the Site's content in whole or in substantial part, in any medium, without prior written permission.

9. Third party services

The Site uses third party services to function. These currently include, and may in the future include, hosting and analytics providers (such as Vercel), email delivery providers (such as Resend), scheduling tools (such as Google Calendar appointment scheduling), and similar tools used to operate the Site or communicate with you.

When you interact with these services through the Site (for example, by booking a call through an embedded scheduler), your use of those services is also governed by the third party's own terms and privacy policy. Trevor Hough is not responsible for the content, terms, or practices of third party services, and including a third party tool on the Site is not an endorsement of that provider for any other purpose.

10. Privacy

How personal information is collected, used, disclosed, and protected on the Site is described in the Privacy Policy, which is incorporated into and forms part of these terms. Where there is any inconsistency between these terms and the Privacy Policy on a privacy matter, the Privacy Policy governs.

The Site complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canada's Anti-Spam Legislation (CASL). Email-gated content and contact forms use express opt in consent where required.

11. Linking and external sites

The Site contains links to third party websites, including regulators (such as FSRA), government agencies (such as the CRA), financial institutions, and other resources. These links are provided for convenience and reference only.

Trevor Hough does not control external sites and is not responsible for their content, accuracy, availability, terms, or privacy practices. Following an external link is your decision and is at your own risk.

12. Limitation of liability

To the fullest extent permitted by the laws of Ontario and Canada, in no event will Trevor Hough, The Mortgage Coach, or any of their respective licensors, contractors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost savings, lost opportunity, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of, or inability to use, the Site or any of its content, calculators, or tools, even if the possibility of such damages was foreseeable.

To the fullest extent permitted by law, the total aggregate liability of Trevor Hough and The Mortgage Coach to you for all claims arising out of or relating to the Site and these terms is limited to the greater of (a) the amounts you have actually paid to access or use the Site (which, for a free to use site, is zero) and (b) one hundred Canadian dollars (CAD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. Where that is the case, the limitations in this section apply to the maximum extent permitted by applicable law, and nothing in these terms is intended to limit any liability that cannot be limited by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Trevor Hough and The Mortgage Coach (and their respective directors, officers, employees, contractors, and agents) from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these terms, (b) your misuse of the Site or its content, or (c) your violation of any applicable law or the rights of any third party in connection with your use of the Site.

Trevor Hough reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with that defence. This section does not require you to indemnify Trevor Hough or The Mortgage Coach for their own negligence or wilful misconduct.

14. Modifications to these terms

Trevor Hough may update these terms from time to time. The current version is always available at this URL, with the “Last updated” date at the top reflecting the most recent revision. Changes take effect when posted.

Your continued use of the Site after an update means you accept the revised terms. If you do not agree with a change, please stop using the Site.

15. Governing law and dispute resolution

These terms and your use of the Site are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of laws principles.

You and Trevor Hough agree that the courts of the Province of Ontario have exclusive jurisdiction and venue over any dispute, claim, or proceeding arising out of or relating to these terms or the Site, and you consent to the personal jurisdiction of those courts.

16. Severability and entire agreement

If any provision of these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in full force and effect.

These terms, together with the Privacy Policy and the Disclaimer, constitute the entire agreement between you and Trevor Hough regarding your use of the Site, and supersede any prior agreements or understandings on that subject. A failure to enforce any provision of these terms is not a waiver of that provision.
